Work Related Injury Compensation Claims

By law, employers are required to take out Workers Compensation Insurance to cover their workers incase of an injury sustained under their care and due to their negligence. In saying this, not all workplace accidents are foreseeable and will be investigated if there is a serious case. This means that it is not only the employer’s duty of care, but the employee’s duty to take care for them self also. 

Obtaining the right legal advice and assistance after injuring yourself is essential to help the healing process and your rehabilitation. Generally, if you are injured at work then you may be able to make a Claim for Compensation under your states Workers Compensation Insurer.  The entitlements may be:

  • Weekly loss of wages
  • Approved medical treatment
  • Lump sum compensation.

Workers Compensation Insurers usually allow a claim to be lodged for a ‘Journey Claim’.  Again, each state does differ with their rules as to what a Journey Claim includes.  The idea of the claim is that if you have a Motor Vehicle Accident travelling to or from work, in between work sites, or for required work travel, then you maybe able to claim;

  • Approved medical treatment
  • Lump sum compensation.
